1. Kasutamu Customs Licence Agreement<\/strong><\/p>\n\n\n\n

1.1 This document is a licence agreement (\"Licence\") by Kasutamu.eu between the user (\"You\") and Kasutamu Customs O\u00dc. The terms of use for products sold in the Kasutamu online store are set out below. By using the 3D models and scans on the Kasutamu website you acknowledge that you have read and understood the terms set out below. If you do not agree to these terms, you may not purchase, download or use any products from our online store.<\/p>\n\n\n\n

1.2 Kasutamu Customs offers digital models and 3D scans on its website (www.kasutamu.eu) for 3D printing and reverse engineering. Our business is mainly motorsport-related, but in the future we also plan to cover rare parts. <\/p>\n\n\n\n

The licence granted with the 3D models gives you no lawful right to distribute or sell these products.<\/p>\n\n\n\n

1.3 All materials, design and product presentation in the Kasutamu Customs online store are the property of Kasutamu Customs O\u00dc. Some models may contain graphic elements such as logos and product names \u2014 the use of such elements is at your own discretion.<\/p>\n\n\n\n

1.4 Both private individuals and businesses may use the 3D scans and models only for research and development purposes.<\/p>\n\n\n\n

1.5 It is NOT in any case permitted to:<\/strong><\/p>\n\n\n\n

\u2013 Sell or distribute these 3D scans and models in unmodified form<\/p>\n\n\n\n

\u2013 Sell parts printed or cast from the 3D scans or models.<\/p>\n\n\n\n

\u2013 Bundle the 3D scans and models with 3D or photo-kiosk software.<\/p>\n\n\n\n

\u2013 Sell or distribute the 3D scans and models via \"print on demand\" services (mugs, T-shirts, mouse mats, etc.)<\/p>\n\n\n\n

\u2013 Use free 3D models for commercial purposes without our permission<\/p>\n\n\n\n

\u2013 Interfere with the security of, or otherwise abuse, disrupt, place excessive load on or attempt to gain unauthorised access to the Kasutamu Customs store website or any system resources or networks connected to it.<\/p>\n\n\n\n

\u2013 Release the 3D scans and models on open-source platforms<\/p>\n\n\n\n

1.6 The Kasutamu Customs store respects the privacy of the personal information of the individuals with whom we interact. The Kasutamu Customs store does not disclose the personal information of its members or of individuals visiting the website. No newsletters or offers will be sent to you without your prior consent. Any information submitted by the buyer is used solely to complete the transaction, deliver the product and resolve customer service issues.<\/p>\n\n\n\n

1.7 All risk and responsibility associated with Kasutamu Customs products lies with the customer.<\/p>\n\n\n\n

The Kasutamu Customs store does not represent or warrant that the site or any content downloadable through it is free of viruses or similar destructive contamination.<\/p>\n\n\n\n

1.8 In no event shall Kasutamu Customs O\u00dc be liable for any incidental, indirect, punitive, exemplary or consequential damages whatsoever, including damages for loss of profits, interruption, loss of business information, loss of data or any other pecuniary loss in connection with any claim, loss, action, suit, damage or other proceeding arising under or out of this Licence, including your use of or access to the Kasutamu Customs O\u00dc store website, the materials or any part thereof, or any rights granted to you hereunder, even if we have been advised of the possibility of such damage, whether the action is based on contract, tort (including negligence), infringement of intellectual property rights or otherwise. This does not limit the statutory rights of consumers or the liability of Kasutamu Customs O\u00dc for intent or gross negligence.<\/p>\n\n\n\n

1.9 You agree to indemnify and hold the Kasutamu Customs store harmless against all claims or liability asserted against it arising out of any breach of this Licence by you or anyone acting on your behalf.<\/p>\n\n\n\n

1.10 This Licence is governed by the laws of Estonia. The parties acknowledge that any legal proceedings take place exclusively in Estonia.<\/p>\n\n\n\n

2. Right of withdrawal<\/strong><\/p>\n\n

2.1 As a consumer you generally have the right to withdraw from the contract within 14 days. For digital content (downloadable files) this right ends once the download has started with your express consent and you have confirmed that you are aware of losing the right of withdrawal (Estonian Law of Obligations Act \u00a7 53(4)(13)).<\/p>\n\n

2.2 You give this consent by ticking the box at checkout before placing the order. Confirmation of your consent is sent to you by e-mail together with the order confirmation.<\/p>\n\n

3. Defective files<\/strong><\/p>\n\n

3.1 If a purchased file is faulty, does not open, does not match the product description or cannot be downloaded, you have your statutory rights: we will repair or replace the file, and if that is not possible, we will refund you.<\/p>\n\n

3.2 Characteristics stated in the product description (for example, a note that a scan contains topological errors) are not a defect.<\/p>\n\n

3.3 Please let us know about a defect as soon as possible by e-mail, including your order number and a description of the problem.<\/p>\n\n

3.4 If you receive a refund, you may no longer use or share the file and must delete it.<\/p>\n\n

3.5 If you have any questions, please contact us before purchasing \u2013 we are happy to help.<\/p>\n\n\n\n\n\n\n\n\n\n
